Witness in Beulah murder conspiracy case sentenced
BISMARCK (AP) -- A witness in a Beulah murder conspiracy case has pleaded guilty to multiple charges of burglary and theft of property but will not see additional jail time.
Eighteen-year-old Avalino Lopez was sentenced to one year in jail with all of it suspended but the time he already has spent behind bars, and put on supervised probation.
Mercer County State's Attorney Jessica Binder said Lopez spent about 50 days in jail. He also was ordered to pay restitution in the May burglaries of homes and garages in Beulah.
Lopez was a witness in the murder conspiracy trial of Richard Whitman and Cody Borner last month. Both men were convicted in the Jan. 31 shooting death of Michael Padilla and the wounding of his brother, Timothy Padilla.
