BISMARCK, N.D. (AP) — An administrative law judge has denied a request for a public hearing in eastern North Dakota on a proposed coal mine near the Theodore Roosevelt National Park.
Allen Hoberg is reviewing a permit application for the mine. It would be near South Heart, about 13 miles from the park's south unit in southwestern North Dakota.
Dickinson businesswoman Kristin Hedger asked Hoberg to hold a hearing on the request in eastern North Dakota. Hedger says there is statewide interest in the project.
Hoberg says the request was late. Two hearings in Dickinson were held on the same day last June. Hoberg says there will be another hearing early next year.
Hoberg will report to the state Public Service Commission. The commission will decide whether to issue the permit.
