The lawsuit says the state is claiming it can sell oil and gas exploration rights on property it doesn't own. The lawsuit says millions of dollars are at stake.
The dispute is about who owns property that's next to the Missouri River and Lake Sakakawea.
The lawsuit says the state is claiming ownership of property that lies below the river's normal high-water mark. It says the state should only be able to claim land that's below the low-water mark.
The dispute has become more intense because sophisticated oil drilling techniques are allowing more exploration underneath the Missouri River and Lake Sakakawea.
