Judgeship will not be transferred

The North Dakota Supreme Court is required to review vacancies and determine within 90 days of receiving notice of a vacancy whether to transfer the judgeship to another district, according to the press release.
Written comments on the vacancy were taken through March 15. The Court received several comments supporting the retention of the position in the Southwest Judicial District and none suggesting it be transferred, according to a press release.
“Based on the record before us, this Court determines this office is necessary for effective judicial administration in its present location,” according to the press release. “It is hereby ordered that Judgeship No. 3 at Dickinson in the Southwest Judicial District be filled, that an election for this office be held, and that this office appear on the 2012 primary and general election ballots in North Dakota.”
Dickinson attorneys Kevin McCabe and Dann Greenwood are pursuing the position.
Weir notified the Supreme Court Feb. 7 he did not intend to be a candidate when his position expires Dec. 31.
Southwest District Judge Zane Anderson’s position is also up for election.
