Warden didn't notify state about prisoner's porn

FARGO, N.D. (AP) — A former warden at the North Dakota penitentiary told federal prosecutors he failed to alert authorities about an inmate's child pornography case because he was unhappy about the way the state handled crimes at the prison.

The issue came to light in court documents involving Damien Breding, who was sentenced Thursday to 27 months in prison for possession of child porn. The crime happened eight years ago while Breding was serving time for killing twin 6-year-old girls.

Federal authorities say they found out about the pornography case after reviewing Breding's file before his scheduled release. Breding was disciplined by prison officials, but the incident was not reported to state or federal authorities.

Timothy Schuetzle was the warden at the time.

Schuetzle declined comment. He retired in 2010.
