A citizens’ lawsuit filed Wednesday by the Dacotah Chapter of the Sierra Club and the Dakota Resource Council alleges that North Dakota Public Service commissioners violated federal campaign contribution laws.
Public Service commissioners Brian Kalk and Kevin Cramer should recuse themselves from decisions regarding a South Heart coal mine project because of campaign contributions they received, four organizations said in letters hand delivered to the two Friday.
BISMARCK (AP) — State regulators said Friday they plan to take more time to review plans to open a new coal mine in southwestern North Dakota after a technical review found hundreds of deficiencies in the application.
After multiple revisions, state officials said Wednesday morning a coal company’s permit application for a nearly 4,600-acre strip coal mine near South Heart is complete and the company also intends to construct a power plant next door.
A coal company has re-submitted its application for a strip coal mine three miles west of South Heart after state officials deemed it deficient in April. If all permits are approved, the mine could be North Dakota’s first in 30 years.
