1.Judgment in the amount of $193,440.19, having been entered in favor of Plaintiff and against Defendants, which Judgment was filed with the Clerk of Courts of Stark County, North Dakota, on November 16, 2020, for the foreclosure of a real estate mortgage.
2.Notice is hereby given pursuant to said Judgment that the real property described as:
All of the following real property lying and being in the City of Dickinson, County of Stark, and State of North Dakota and described as follows, to-wit: Lot 5, Block 9, Heart River 2nd Subdivision located in the SE4 of Township 139 North, Range 96 West of the 5th P.M.
MORE CORRECTLY DESCRIBED AS FOLLOWS:
All of the following real property lying and being in the City of Dickinson, County of Stark, and State of North Dakota and described as follows, to-wit: Lot 5, Block 9, Heart River 2nd Subdivision located in the SE1/4 of Section 9 in Township 139 North, Range 96 West of the 5th P.M.
With an address of 548 4th Avenue SW, Dickinson, ND 58601, and being the subject of the Mortgage dated November 20, 2017, which Mortgagor, Marlene Schopp, executed and delivered to Mortgage Electronic Registration Systems, Inc., as Mortgagee, as nominee for American Advisors Group, its successors and assigns, and recorded in the office of the Clerk and Recorder of Stark County, North Dakota, on November 30, 2017, Instrument Number 3144190, is subject to the entered Judgment. Said Mortgage was assigned to Plaintiff, its successors or assigns, by Assignment of Mortgage recorded April 18, 2019, Instrument Number 3151384.
3.In order to realize the amount of $193,440.19, as of November 16, 2020, plus interest accruing thereafter on said amount at the rate of 4.712% per year together with the costs and expenses of sale, the property will be sold subject to redemption as provided by law as one parcel of land at public auction, subject to any lien for unpaid real estate taxes and assessments of Stark County, North Dakota, and easements and restrictions of record, to the highest bidder for cash under the direction of the Sheriff of Stark County, North Dakota, at the main entrance of the Stark County Courthouse located at 51 3rd Street East, Dickinson, ND 58601, on February 3, 2021 ("Sale Date"), at 10:00 AM.
4.If the sale is set aside for reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid. The purchaser shall have no further recourse against the Mortgagor, the Mortgagee or the Mortgagee's attorney.
