ROLL CALL: Hurt, Sticka, Binstock, Lefor, Splichal, Praus
ALSO PRESENT: Peter Kuntz, Joel Quanbeck, Luke Stoner, Becky Stoner, Regina Stoner, Tom Splichal, Sandy Kuntz (City Attorney), Tim Ridl (Roughrider Electric)
APPROVAL OF AGENDA:
A motion to approve the agenda was made by Councilman Lefor and seconded by Councilman Sticka. All in favor.
REGULAR MEETING: was called to order by Mayor Hurt at 7:00pm
MINUTES:
A motion to approve the September 3, 2019 Zoning Meeting Minutes was made by Councilwomen Splichal and seconded by Councilman Sticka. Motion carried. All in favor.

ROUGHRIDER ELECTRIC EASEMENT:
Roughrider Electric would like approval of their easement to bore utilities under the Heart River to service the golf course area. A motion to approve the easement upon the approval from Sandy Kuntz (city attorney) was made by Councilman Lefor and seconded by Councilman Binstock. All in favor.
GINNY ALEXANDER-GAMING PERMIT:
A motion to approve the medical benefit gaming permit was made by Councilwomen Splichal and seconded by Councilman Sticka. All in favor.
STREET COMMISSIONER:
Street Commissioner Binstock informed the council Prairie Paving will be out when the weather permits to patch the streets where the water lines were dug up for repairs. Councilwomen Splichal inquired about the repairs on the streets in Pheasant Run Sub Division and Mayor Hurt informed the council due to the wet conditions they had to shut down and plan to return when the weather conditions improve.
WATER COMMISSIONER:
Mayor Hurt reported JK Excavation has installed the new valve up at the tower and Dakota Pump plans to come back in couple weeks to complete the project.
The line was repaired on Rudolph Ave to give each property a shut off valve at the curb.
The hole by third street was dug up and repaired the lines were not the issue just a soft spot in the street.
Hurt plans on attending a Water and Pollution Conference in Bismarck tomorrow for three days.
JOEL QUANBECK: KLJ
Mr. Quanbeck was present to discuss the Multi-Hazard Mitigation Plan for Stark County and get the councils concerns for the community.
SEWER DEPARTMENT:
Mayor Hurt reported the lift station check valve was replaced by Pump Systems and cost was about $1500.00.
SANDRA KUNTZ (CITY ATTORNEY)
Attorney Kuntz presented the contract from the Stark County Sherriff Department for providing law enforcement services to the city of South Heart the contract is for a 12 month period at a cost of $1000.00 per month. The council reviewed the contract and had a couple changes regarding the start date and the radios. A motion to approve the contract upon the city attorney's approval after the changes regarding the radios and the start date was made by Councilwomen Splichal and seconded by Councilman Lefor. All in favor.
The council discussed the old RV Park and does not wish to sell the property.
OTHERS:
The council discussed filling the vacant fire liaison position and Mayor Hurt would like to appoint Councilman Binstock. The auditor will notify Fire Chief Jesse Olson so he can get in contact with Councilman Binstock.
A motion was made to approve the cost of a new sign at the bank building up to $700.00 by Councilman Sticka and seconded by Councilwomen Splichal. All in favor.
The council discussed the Toro mower and they agreed to have it serviced and checked over. Councilman Binstock will check on some lease options and report back at the next meeting.
UTILITY BILLS:
The council reviewed the past due accounts and requested the auditor to send out past due notices and give the individuals 10 days to pay the past due amounts or they will be shut off and service will be not be reconnected until the account balance is current and all fees for reconnection are paid in full. The council discussed shutting off the delinquent accounts and will be charging them the current disconnect and reconnect fees as stated in the city ordinances.

A motion to pay vouchers for the month of September, approve the Financial Reports as submitted was made by Councilman Sticka and seconded by Councilman Lefor. All in favor. Motion carried.
