NORTH DAKOTA DEPARTMENT OF ENVIRONMENTAL QUALITY PUBLIC NOTICE OF OPPORTUNITY TO COMMENT ON DRAFT GENERAL PERMIT FOR A SOLID WASTE MANAGEMENT FACILITY UNDER THE NORTH DAKOTA SOLID WASTE MANAGEMENT RULES APPLICANT NAME: Single-Use Land Treatment Site for Petroleum-Contaminated Soil General Permit MAILING ADDRESS: North Dakota Department of Environmental Quality Division of Waste Management 4201 Normandy Street Bismarck, ND 58503 TELEPHONE NUMBER: 701-328-5166 PROPOSED PERMIT EXPIRATION DATE: 5 years from permit issuance BACKGROUND: The North Dakota Department of Environmental Quality – Solid Waste Program (Department) proposes to issue the Single-Use Land Treatment Site for Petroleum-Contaminated Soil General Permit to authorize a person who obtains coverage under this general permit to construct and operate a solid waste management facility (site) for the purpose of land treatment of petroleum contaminated soil in accordance with North Dakota Century Code Chapter (NDCC) 23.1-08 and North Dakota Administrative Code Article (NDAC) 33.1-20. The general permit requires authorization to be obtained prior to commencing any land treatment operations. The general permit includes conditions regarding location, design, operations, recordkeeping and reporting, closure and financial assurance. “General permit” means a regional or statewide permit issued by the department for a specified category of beneficial use, processing or treatment of solid waste, the terms and conditions of which allow a person to operate under the permit if the terms and conditions of the permit and requirements of this article are met. (NDAC Subsection 33.1-20-01.1-03(36)) The Department believes that a general permit which meets the requirements of the North Dakota Solid Waste Management Rules and is protective of human health and the environment can be issued and has prepared a Draft General Permit for public review and comment. PUBLIC COMMENTS AND HEARING As required by Section 33.1-20-03.1-03 of the North Dakota Administrative Code, the Draft General Permit will be available for public review and comment for thirty (30) days following publication of the Public Notice. The public comment period begins June 22, 2022 and ends July 29, 2022. During that time, any interested persons may submit written comments to the Department on the Draft General Permit. The Department has scheduled a public hearing on the Draft General Permit on July 14, 2022 at 1pm at the Department’s Bismarck Office (Normandy Building), 4201 Normandy Street, Bismarck, ND. The North Dakota Department of Environmental Quality will consider all comments prior to taking any action on the general permit.
