NOTICE OF HEARING N.D. INDUSTRIAL COMMISSION OIL AND GAS DIVISION The North Dakota Industrial Commission will hold a public hearing at 09:00 AM Thursday, February 23, 2023 at N.D. Oil & Gas Division 1000 East Calgary Avenue Bismarck, North Dakota. At the hearing the Commission will receive testimony and exhibits. STATE OF NORTH DAKOTA TO: Case No. 29868: Application of Spotted Hawk Development, LLC for an order amending the field rules for the Van Hook-Bakken Pool, McLean and Dunn Counties, ND, so as to create and establish an overlapping 3520-acre spacing unit comprised of Sections 16, 17, 18, 19, 20, and N/2 of Section 21, T.150N., R.91W., authorizing the drilling of a total not to exceed eight horizontal wells on said proposed overlapping 3520-acre spacing unit, and such other and further relief as appropriate. Case No. 29869: Application of Enerplus Resources USA Corp. for an order authorizing a setback variance of 50’ from the tank batteries for two backup diesel generators to generate power for communication equipment for oil and gas wells drilled and completed or to be drilled and completed in Section 31, and Section 36, T.149N., R.95W., and Section 29, T.149N., R.93W., Eagle Nest-Bakken Pool, and Mandaree-Bakken Pool, McKenzie and Dunn Counties, ND, as an exception to the provisions of Section 43-02-03-28 of the NDAC, and providing such other and further relief. Case No. 29872: Application of Continental Resources, Inc. for an order authorizing the use of double wall open receptacles (designed for containment in the event of an inner tank failure) for storage of produced water to allow fracture stimulation of the Micahlucas 11-5H well, Micahlucas 12-5H1 well, Micahlucas 13-5HSL well, and Micahlucas 14-5HSL1 well, SESE of Section 5; Micahlucas 5-5H well, Micahlucas 6-5H1 well, and Micahlucas 7-5H well, SESW of Section 5, and the Micahlucas 8-5H1 well, Micahlucas 9-5H well, and Micahlucas 10-5H well, SWSE of Section 5, T.145N., R.96W., Jim Creek Field, Dunn County, ND, as an exception to the provisions of Section 43-02-03-19.3 of the NDAC and such other and further relief. Case No. 29877: In the matter of the petition for a risk penalty of SOGC, Inc. requesting an order authorizing the recovery of a risk penalty from certain non-participating owners, as provided by NDCC § 38-08-08 in the drilling and completing of the Hovden Federal 2-20H well (File No. 38862) located in a spacing unit described as Sections 17 and 20, T.146N., R.97W., Little Knife-Bakken Pool, Dunn County, ND, pursuant to NDAC § 43-02-03-88.1, and such other relief as is appropriate. Case No. 29878: In the matter of the petition for a risk penalty of SOGC, Inc. requesting an order authorizing the recovery of a risk penalty from certain non-participating owners, as provided by NDCC § 38-08-08 in the drilling and completing of the Hovden Federal 3-20H well (File No. 38863) located in a spacing unit described as Sections 17 and 20, T.146N., R.97W., Little Knife-Bakken Pool, Dunn County, ND, pursuant to NDAC § 43-02-03-88.1, and such other relief as is appropriate. Case No. 29879: In the matter of the petition for a risk penalty of SOGC, Inc. requesting an order authorizing the recovery of a risk penalty from certain non-participating owners, as provided by NDCC § 38-08-08 in the drilling and completing of the Hovden Federal 4-20H well (File No. 39142) located in a spacing unit described as Sections 17 and 20, T.146N., R.97W., Little Knife-Bakken Pool, Dunn County, ND, pursuant to NDAC § 43-02-03-88.1, and such other relief as is appropriate.
