OFFICIAL PROCEEDINGS DUNN COUNTY BOARD OF COUNTY COMMISSIONERS February 1, 2023 Members Present: Commissioners Lundberg, Dolezal, Buehner, Kleemann and Pelton Others Present: Sally Whittingham, David Lym, Carl Rohde, James Kadrmas, Jeremy Wood, Dessie Calihou, Harold Detinger, Christina Kissinger, Mike Buresh, Adeline Ingold, Willard Tormachy Motion by Commissioner Pelton seconded by Commissioner Buehner, to approve the January 18th minutes. All voted aye, motion carried. Motion by Commissioner Buehner , seconded by Commissioner Dolezal to accept the agenda with the following additions , JDA Housing, SW Night at the Legislators, and the 2022 Financial Audit. All voted aye, motion carried. Carl Rohde appeared for Civil Science to give updates on the projects his firm is working on. Getting the 2023 and 2024 projects geared up. Darin Schaeffer with Bartlett & West appeared via Teams and gave updates on the projects for their company. James Kadrmas with Interstate Engineering appeared via Teams to update the commission on their projects Jeremy Wood with Northern Plains Engineering gave updates on projects that the company is working on. David Lym, Superintendent discussed the Joint Powers of agreement with the golf course, it was signed, asking for a final approval to get started on the project. Motion by Commissioner Dolezal, seconded by Commissioner Buehner, to approve the joint power of agreement. Roll call vote, all voted aye, motion carried. David Lym suggested that Civil Science take on the project of the Golf Course Road. Commissioner Buehner moved to have Civil Science take on the project, seconded by Commissioner Dolezal. All voted aye, motion carried. Superintendent Lym presented Mike Buresh with an award for years of service. Mike has been with the county for 40 years. His service is appreciated. David Lym is asking for the following utility permits to be approved, ONEOK and McKenzie Electric. Motion to approve utility permits as presented by Commissioner Pelton and seconded by Commissioner Kleemann. All voted aye, motion carried. At 10:00 a.m., per call for bids, all qualified contractor bids were opened on the 25th St. SW and 88th Ave SW project Martin Construction $868,455.07 Hlebechuk Construction Inc. $790,798.62 Edward H. Schwartz Construction Inc. $864,931.34 Baranko Brothers Inc. $927,384.10 Wilson Construction Inc. $862,692.49 Engineers Estimate; $810,000.00 Engineer Wood took the bids for review and will report back for recommendation. Doug Arens with Legendary Oilfield Service and Jonas Biffert appeared to discuss to have the contractors contact the land owners when they procure water. The water commission regulates the rules as to how the State Water Commission is permitting the water. Commission is referring him back to the State Water Commission. He has retracted his invoice with the county. There was discussion on SW Night with the Legislators and the different levels of sponsorship, the amount this year is $1250.00. Everyone feels it is an important event to meet with the legislators about what is going on with several different bills that will affect the county. Motion by Commissioner Dolezal, seconded by Commissioner Pelton to approve the sponsorship. Roll call vote, all voted aye, motion carried. Commissioner Lundberg discussed the importance of filling out the survey from Roosevelt Custer Regional Council. By filling it out and getting feedback it helps in getting some grants, this will help fund the regional councils. Bowan is now administering the Roosevelt Custer program. Will Albrecht and Carie Boster with the Park Board appeared to present information about a Lease Agreement for the cabin owners at Skunk Bay. The 2020 County Commission had approved the work. It has taken this long to receive the required public easements. The Recreational lease would be held by the County Commission and managed by the Park Board. The Park Board is asking for approval of the new board to move forward with submitting the permit lease request. Motion by Commissioner Pelton, seconded by Commissioner Dolezal to submit the application for the permit lease. All voted aye, motion carried. Emergency Manager, Sarah Duttenhefner presented a quote for a new vehicle. The total amount for the vehicle and the cost of the set-up is $ 61,620.89. The delivery would be May. Motion to approve the purchase of the vehicle as presented by Commissioner Pelton, seconded by Commissioner Kleemann. Roll Call vote, all voted aye, motion carried. After checking the bids for the 25th St. SW and 88th Ave SW project , Jeremy Wood, with Northern Plains Engineering appeared to present the bids. Hlebechuk Construction Inc. was the lowest bidder. Move to accept the bid by Commission Dolezal and seconded by Commissioner Pelton. All voted aye, motion carried. Chief Deputy Harold Dentinger appeared before the Commission and is asking for approval for Hettinger County to be able to borrow a K-9 patrol vehicle. This is one of two spares and will not leave the county without coverage. Motion by Commissioner Dolezal, seconded by Commissioner Buehner to allow Hettinger to use the vehicle. All voted aye, motion carried. Carie Boster with JDA appeared to discuss the Housing Program. They changed wording for the down payment incentive program. By doing so it will be available for residents to use the program. Also, would make it so an applicant can only use once in five years. Motion to by Commissioner Kleemann, seconded by Commissioner Dolezal to make changes as presented. All voted aye, motion carried. Interim Auditor Whittingham presented to the Commission use Rath & Mehrer as annual auditors. They said they would not be able to do our audit any longer but have since hired a CPA. They called back and asked if we would like them to do our annual audit rather than using a new firm. Motion by Commissioner Pelton, seconded by Commissioner Buehner to use Rath and Mehrer as presented. All voted aye, motion carried. Commissioner Dolezal discussed standardizing the board payments to one rate. Right now, there are different rates depending on the board. Suggestion of $125.00 per meeting. Motion by Commissioner Pelton, seconded by Commissioner Dolezal to recommend paying $125.00 per meeting for the Weed, Housing Authority, Planning and Zoning, and Park Boards. Roll call vote, all voted aye, motion carried. Discussion about board openings to be advertised somewhere so more people can be involved, also make a simple application for people to apply. Communications Team discussed about putting the information on the website. Motion to remove from table the Planning & Zoning requirements by Commissioner Dolezal, seconded by Commissioner Buehner. All voted aye, motion carried. Legislation is trying to pass a new bill that may affect permitting ponds. We should wait until the new bills are passed before making changes. This will change what impact it has on the County and Water Commission. The Water Resources board has some role in what is going on. Planning & Zoning is to find out the language of the bill in legislation. Discussion on having checks and balances with all permits to ensure people are following the rules. Christina Kissinger State’s Attorney appeared to discuss the need for a portfolio holder. She is comfortable not having one and feels it is not necessary. Chairman Lundberg unappointed Commission Buehner from the State’s Attorney as the portfolio holder.
