OFFICIAL PROCEEDINGS DUNN COUNTY BOARD OF COUNTY COMMISSIONERS March 1, 2023 Members Present: Commissioners Lundberg, Dolezal, Buehner, Kleemann and Pelton Others Present: Sally Whittingham, David Lym, Carl Rohde, James Kadrmas, Eric Urness, Dessie Calihou, Del Olson, Matt Johnson, Jeremey Wood, Guy Aman, Gary Kuhn, Adeline Ingold, Julie Karey Motion by Commissioner Buehner seconded by Commissioner Dolezal, to approve the February 15th minutes as presented. All voted aye, motion carried. Motion by Commissioner Dolezal, seconded by Commissioner Buehner to accept the agenda with the following additions, Communications Specialist position, Rural Attorney Recruitment Program, Park Board update on Little Mo Campground, introduce new Deputy Auditor, Deb Harchse for county property for sale, Gravel Lease approvals. All voted aye, motion carried. Interim Auditor Whittingham introduced the new Deputy Auditor, Sara Lawrey, Sara comes to us from Dickinson School District with over 7 years of accounting experience. Carl Rohde appeared for Civil Science to give updates on the projects his firm is working on. 86th Ave. SW, 92nd Ave. SW, 15th St. Box Culvert and updates on the 2024 projects. Darin Schaeffer with Bartlett & West appeared via Teams and gave updates on the projects for their company. Manning Improvements,2nd Street NW/84th Ave NW. 2024 projects will be brought to the commission in the next meeting. James Kadrmas with Interstate Engineering appeared to update the commission on their projects. 109th Ave SW is waiting on land owners for easement agreements, some discussion on the progress of the report. 82nd Ave SW, 26th St. SW, 27th St. SW Jeremy Wood with Northern Plains Engineering, gave updates on projects that the company is working on. Gap Road and 111th bid results, once unit prices were applied there were no errors in bid amounts. Central Specialties was the lowest bid. Recommending the commission to award the Alternate A bid as well, this is for safety reasons. Motion by Commissioner Pelton, seconded Commissioner Dolezal, to award bid with the alternate A to Central Specialties as presented for $8,594,560.78. Roll call vote, all voted aye, motion carried. Superintendent David Lym presented the bid results from the previous Commission Meeting, the results can be found on our website can under the Road Department and 2023 bids. Hauling, Fencing and Equipment bids for the County. Superintendent Lym presented utility permits from, Tesoro Pipeline and ONEOK, he is recommending them for approval. Motion to approve the permits as presented by Commissioner Dolezal, seconded by Commissioner Kleemann. All voted aye, motion carried. Superintendent Lym presented Gravel Lease Agreements for two property owners for approval. The Bang property and the Olson property. Motion to approve as presented by Commissioner Pelton, seconded by Commissioner Buehner. All voted aye, motion carried. Del Olson appeared to discuss the open house for the new Killdeer Shop. It will be Thursday, June 29th, from 11:00 a.m. to 2:00 p.m. It will be combined with County Road Days. They are asking for approval to serve lunch during the open house. Motion to approve the Open House with lunch by Commissioner Dolezal, seconded by Commissioner Buehner. Upon roll call vote, all voted aye, motion carried. Guy Aman with Continental Resources appeared to discuss a County Road Use Agreement. This is a project specific agreement. Continental would be responsible for road maintenance and repair while the drilling and frac projects were going on. Motion by Commissioner Dolezal, seconded by Commissioner Pelton to approve the use of this agreement as a template, each project would need to be approved by the Commission. Upon the completion of the first project the Commission will evaluate how the process is working. Roll call vote, all aye, motion carried. Interim Auditor Whittingham presented an annual Gaming Site Authorization from the Dunn County Fair Board for the Dog House Bar. This would be for fiscal year July 1, 2023 to June 30, 2024. Authorization needs a signature. Motion by Commissioner Pelton, seconded by Commissioner Kleemann to accept the authorization as presented. All voted aye, motion carried. Commissioner Dolezal gave updates on the Halliday School dissolution. Any remaining money left in the Halliday accounts up to the previous year general fund expenditures needs to be given to the Halliday tax payers. It can be done as a credit on taxes or a refund. After consideration the best way would be to give a refund check. The money over the amount refunded will go to the receiving school districts proportionate to the taxable value that is attached to the receiving district. Motion by Commissioner Lundberg, seconded by Commissioner Buehner, to issue refund checks for remaining dollars up to the previous year general fund expenditures as a refund check. Roll call vote, all aye, motion carried. Commissioner Dolezal discussed the School Grant Program. The money is usually distributed in June. This is done through an application process. The bond debts for the schools are due now. Would like to start the process now and pay out the grant funds to the schools in March. Motion by Commissioner Dolezal, seconded by Commissioner Lundberg to release grant funds by March 15th to use the money to pay down bond debts per terms on the application. Roll call vote, all aye, motion carried. Tom Steffan appeared to discuss the Auditor Position. Jason North appeared with Mr. Steffan to introduce himself as someone who would be interested in the position. Deb Harsche appeared to give an update on the county properties that are for sale. Another offer was made for the salt shed. It was presented for $80,000.00 the same offer as the City of Killdeer. All is contingent on the proper legal description and survey. Motion by Commissioner Lundberg, seconded by Commissioner Dolezal to approve the sale of the salt shed to the City of Killdeer for $80,000.00. Roll call vote, Commissioners Buehner, Dolezal, Lundberg and Pelton aye, Commissioner Kleemann voted nay, motion carried. Jeremy Wood with Northern Plains Engineering appeared to propose a range for the cost of surveying all of the Dunn County property that is for sale. The time would be 2 to 3 weeks for the work to be completed. The cost would be between $2800.00 to $4500.00 to complete the surveys. They would be complete by the 1st April meeting. Motion by Commissioner Buehner, seconded by Commissioner Dolezal accept the proposal as presented. Roll call vote, all voted aye, motion carried. Motion by Commissioner Dolezal, seconded by Commissioner Buehner to approve the Soil Conservation offer for the Hoots Building for $150,000.00 pending the completion of the survey. Roll call vote, all voted aye, motion carried. Dessie Calihou, HR Director, appeared to discuss the recommendation for the Communication Specialist position. She explained how the interview process was conducted. The interview committee has recommended to hire Ms. LoAnn Roshau for the position. The amount would be $31.92 per hour. Motion to hire the candidate as presented by Commissioner Pelton, seconded by Commissioner Dolezal. Roll call vote, all aye, motion carried. Commissioner Lundberg is asking the board to give signing authority to Commissioner Pelton and Commissioner Dolezal for the Opioid Settlement documents to make it so Dunn County can receive additional funds from the settlement. It is hard to add or change signers. The money needs to be spent on specific things that relate to the training, prevention, etc. of Opioid use. The Commission reviewed the salary increase that the State’s Attorney Christina Kissinger is asking for. She is asking for the amount that was budgeted for the State’s Attorney in 2023, $102,024.00. This would be the amount for the continued service of the previous State’s Attorney. Motion by Commissioner Pelton, seconded by Commissioner Kleemann to resend the salary of $90,204.00 and make it the budgeted amount of $102,024.00. Roll call vote, Commissioners Pelton and Kleemann vote aye, Commissioners Dolezal, Buehner and Lundberg voted nay. Motion failed. Commissioner Pelton gave an update on Marathon Oil. Currently they have three drill rigs, six sites without rigs, and one completion in Dunn County. Carie Boster with JDA appeared to discuss the Rural Attorney Recruitment Program. Dunn County has been accepted by the ND Supreme Court into the program. Carie explained how the program works, it is a benefit to the citizens of Dunn County. Carie Boster appeared for the Park Board. The Park Board is letting the Commissioners know that the portal opened for reservations at the Little Mo campground for the 2023 season. Commissioner Pelton let the Commissioners know about the Vision West Natural Resource meeting on Monday, March 6th. The meeting will be held in Dickinson and will cover different topics that relate to our county.
