OFFICIAL PROCEEDINGS DUNN COUNTY BOARD OF COUNTY COMMISSIONERS April 19, 2023 Members Present: Commissioners Dolezal, Buehner, Kleemann and Pelton Others Present: Sally Whittingham, David Lym, Carl Rohde, James Kadrmas, Dessie Calihou, Jeremey Wood, Darin Schaeffer, Christina Kissinger, LoAnn Roshau, Adeline Ingold, Julie Karey, Gary Kuhn Motion by Commissioner Dolezal, seconded by Commissioner Kleemann, to approve the April 5th minutes as presented. All voted aye, motion carried. Motion by Commissioner Pelton, seconded by Commissioner Dolezal to accept the agenda with the following changes, Food Pantry, Killdeer County Shop. All voted aye, motion carried. Carl Rohde appeared for Civil Science to give updates on the projects his firm is working on. Project #CS-13(22) 01 86th Ave SW plans are 99 % complete, # CS-13(22)02 92nd Ave SW. Recapped the 2024 projects. Darin Schaeffer with Bartlett & West appeared and gave updates on the projects for their company. Manning Improvements, 2nd St. NW/84th Ave. NW. 2024 projects have been submitted for approval, will start contacting the landowners once they are authorized. James Kadrmas with Interstate Engineering appeared to update the commission on their projects. #E21-00-071: 109th Ave SW. Scheduled a meeting with David Lym and Commissioner Pelton to discuss the future of this project. 82nd Ave SW, positive feedback with the landowners. 26th St. SW, design is moving along quickly. 27th St. SW, continue to obtain signed easements. Jeremy Wood with Northern Plains Engineering, gave updates on projects that the company is working on. CP-13(21)03 – 91st Ave, project will resume this spring. Contacting landowner for one more signature. CP – 13(22) 05 – 25th St. and 88th Ave SW, CP -13 (23)01 Gap Road and 111th Ave. NW, 108M Bridge. CP-13(21)01-25th St, CP – 13(21) 05 Charlies Pass, CP – 13(22)03 97th Ave and 11th St. SW, CP -13 (22)04 4th St. SW, BIA 10, Federal Aid Bridge Replacements. Motion by Commissioner Pelton, seconded by Commissioner Kleemann to get started on the 25th bridge replacement plan. Upon roll call vote, all voted aye, motion carried. Motion by Commissioner Dolezal, seconded by Commissioner Pelton to proceed with field study on the 92nd Ave. Hydrology Study and the design on a culvert box. All voted aye, motion carried. Commissioner Pelton went over all the changes and budget on the new Killdeer Shop, we are under budget on the contingencies and on time for a move in date. May 12th will be completed. Vision West ND is putting on the annual Behavioral Health Summit, June 21st and 22nd in Dickinson at the Astoria. Discussion on the amount of sponsorship the county would like to approve. Motion to sponsor the Vision West Behavioral Health Summit in the amount of $7500.00 by Commissioner Pelton, seconded by Commissioner Dolezal. Upon roll call vote, all voted aye, motion carried. Interim Auditor Whittingham presented a signed School Grant Application from Killdeer Public School to be submitted for payment. The amounts paid are based on Dunn County student enrollments. Motion by Commissioner Dolezal, seconded by Commissioner Pelton to approve the grant application for payment, $5,872,699.39. Upon roll call vote, all voted aye, motion carried. Discussion on whether the commission will still support the architect fees for the construction of a new building for the Dunn County Food Pantry. In order to go forward the county would like a location and have a package presented as to what the food pantry is asking the county to fund. The Commission would help, more information is needed. Vince Herrera with McKenzie Electric appeared to get approval for overhead lines. This would be for two crossing permits. Spring Creek Road, new tap that will serve a water well for agriculture. 2nd St. SW, new service for a water well for livestock. Also, a three-phase underground for 113th. Motion by Commissioner Kleemann, seconded by Commissioner Dolezal to approve the utility permits. All voted aye, motion carried. Dessie Calihou, HR Director, appeared to discuss an employee of the quarter/year program. It was discussed at the Department Head meeting and was well received. The cost of the program would be around $2000.00 each year. Discussion to highlight individuals that go above and beyond their general duties. Gives people an incentive to better themselves and their work. Motion to approve the employee of the quarter/year program by Commissioner Dolezal, seconded by Commissioner Buehner. Upon a roll call vote Commissioners Dolezal and Buehner voted aye, Commissioners Pelton and Kleemann vote nay, motion failed. Florine Lazorenko with the Dunn County Fair Board appeared before the board to give updates on the 2023 Fair. It will be held July 7th, 8th and 9th. There will be a carnival, concerts and a 4-H Exhibit and more. Motion to sponsor the county supper Saturday July 8th by Commissioner Dolezal, seconded by Commissioner Pelton. All voted aye, motion carried. Diane Allmendinger, Weed Control Officer, appeared to discuss the opportunity to get a $7500.00 grant from the State of ND to get GPS Units on each four-wheeler and side by side, this will track where we have sprayed. An additional $25,350.00 is needed to get the units and have them installed. Will get training on using the units. They will be installed this spraying season. Motion to approve the cost of $25,350.00 for the GPS Units by Commissioner Buehner, seconded by Commissioner Dolezal. Upon roll call vote, all voted aye, motion carried. Rebecca Yarger appeared to discuss the County Agent Report. They doing a lot of water and soil sampling. They are planting seeds for the junior gardener program. They continue to work with the nursing home and food pantries. Lisa Guenther appeared to discuss the City of Killdeer Consolidated Channel. The channel is up and running on the new equipment. Once we have a Memo of Understanding in place, the county will start broadcasting information on the Consolidated channel. Motion by Commissioner Pelton, seconded by Commissioner Dolezal to send up to four employees to the NDACo Conference in October. Department heads would recommend individuals. The same guidelines will be followed as the employee of the quarter/year but leave out that verbiage. Upon roll call vote, all voted aye, motion carried. Code Administrator Sandy Rohde appeared to present the CUP applications recommended at the April 11th Planning & Zoning Board Meeting. Asking to approve the following permits. 1. Phillip Olson of Dickinson ND, representing ND Energy Services has filed a Conditional Use Permit for a Water Depot with a pond under 50-acre feet located in the SW4 of section 2-144-96. The property is zoned Rural Preservation and owned by Gerald & Laurie Kulish (Permit #04-2023) 2. Karolina Lym of New Hradec, representing Karolina Lym Photography who has filed a Conditional Use Permit for Personnel Services Photography Studio located on a lot at 105 Layfette St. New Hradec in section 29-141-96. The property is zoned Rural Residential District and owned by David Lym. (Permit #05-2023) 3. Robert Ferebee of Halliday ND, representing Robert Ferebee Water, LLC has filed a Conditional Use Permit for a Water Depot with a 38.7-Acre foot pond located in the W2 of section 23-145-92. The property is zoned Rural Preservation and owned by Robert & Amy Ferebee. (Permit #06-2023) 4. David Lym and Del Olson of Killdeer ND, representing Dunn County has filed a Conditional Use Permit for a 17.0-acre Gravel Pit located in the NW4 of section 6-145-96, The property is zoned Rural Preservation and owned by Duane Olson. (Permit #07-2023) Motion to approve the CUP’s by Commissioner Kleemann, seconded by Commissioner Dolezal. Discussion on item 5 of the CUP’s. The Zoning Board voted to deny permit #08-2033. The gravel pit is located in the center of several houses. Concern of the proximity to the residences. The dust is an issue if it is stock piled over a period of time. The Road Dept. would like time to see if there is an alternate plan. Leone Linseth appeared to discuss concerns the homeowners have about the gravel pit. Motion to table a decision by Commissioner Dolezal, seconded by Commissioner Pelton until the next meeting, May 3rd. All voted aye, motion carried. Motion by Commissioner Kleemann, seconded by Commissioner Dolezal to adjourn.
