MINUTES

ACCOUNTS PAYABLE
Chairman Franchuk mentioned County Park bills of $29,850 didn't transfer onto the resolution report and was added to the presented bills. County Parks Director, Lisa Heiser, commented that these bills were from her $30K budgeted item Capital Improvements where cameras were added to the Motorsports Park and change out/additions of cameras at the Fairgrounds & Events Park. COVID CONTINUITY OPERATIONS/RESPONSE PLAN - APPENDIX 1 ADDITION
Shawna Davenport reported that there was a need to add appendix to address the orange status and mandates by the Governor. Commissioner Messer mentioned changing as the Governor changes. MOTION BY: Commissioner Zander SECONDED BY: Commissioner Arthaud To approve plan as presented to make the plan fluid to change with the Governor's changes. DISPOSITION: Roll call vote. All voted aye. RADAR SERVICE CONTRACT
The annual contract for a 2021 weather radar services provided by ND Atmospheric Resource Board was presented by Shawna Davenport. Commissioner Zander mentioned item number 4 if a motion should be made to change the contact person. It was stated that the Emergency Manager, Shawna Davenport is the contact by virtue of her office being the contact. MOTION BY: Commissioner Arthaud SECONDED BY: Commissioner Marsh To approve the Chairman to sign the contract and appoint Shawna Davenport the point of contact. DISPOSITION: Roll call vote. All voted aye. Motion Carried.
STATE'S ATTORNEY RESIGNATION
Chairman Franchuk received a letter dated December 16, 2020 from State's Attorney Tom Henning resigning his position effective February 1, 2021. MOTION BY: Commissioner Messer SECONDED BY: Commissioner Arthaud To accept resignation of the State's Attorney effective February 1, 2021. DISPOSITION: Roll call vote. All voted aye. Motion Carried.
Chairman Franchuk recommended this Board appoint a new State's Attorney. MOTION BY: Commissioner Messer SECONDED BY: Commissioner Zander To appoint Amanda Engelstad as the State's Attorney effective February 1, 2021. DISPOSITION: Roll call vote. All voted aye. Motion Carried.
ARMOR INTERACTIVE SERVICE TERMINATION
Commissioners and Department Heads received a letter of contract termination dated December 21, 2020 from Kyle Baltrusch owner of Armor Interactive citing conflicting directives from elected officials. Services will be provided until January 31, 2021. MOTION BY: Commissioner Messer SECONDED BY: Commissioner Arthaud To accept the termination of contact effective January 31, 2021. DISPOSITION: Roll call vote. All voted aye. Motion Carried.
Chairman Franchuk suggested consideration of a committee to be formed to research options for internet technologies services. MOTION BY: Commissioner Zander SECONDED BY: Commissioner To have Chairman Franchuk and Commissioner Marsh serve on this committee. DISPOSITION: Commissioner Zander withdrew his motion. No Vote.
MOTION BY: Commissioner Marsh SECONDED BY: Commissioner Messer To appoint Commissioner Messer, Commissioner Arthaud, and Amanda Engelstad as the committee to research internet technology services replacement. DISPOSITION: Roll call vote. All voted aye. Motion Carried.
HR DIRECTOR UPDATE
Commissioner Messer updated that 5 interviews have taken place. Interview committee would like to designate finalists, however, the motion from the December 8th meeting did not declare the committee as authorized to name the finalists. MOTION BY: Commissioner Messer SECONDED BY: Commissioner Arthaud To authorize the interview committee to name finalists. DISPOSITION: Roll call vote. All voted aye. Motion Carried.
MOTION BY: Commissioner Arthaud SECONDED BY: Commissioner Zander To authorize the interview committee to bring one final candidate to the Commission for recommendation of hire. DISPOSITION: Roll call vote. All voted aye. Motion Carried.
OPEN RECORDS REQUEST POLICY A copy of the ND Attorney General's Open Records Guide was provided to Commissioners. Chairman Franchuk referenced an email he sent to county employees. Amanda Engelstad commented that we need to have legally trained staff determining what is considered open record and what is not to properly protect the county. Eldon Meher spoke on behalf of the Sheriff's Office as they routinely release crash reports and other documents. Chairman Franchuk stated all employees should alert Department Head or Portfolio Holder that an open record request was received until such time as an HR Policy is in place. MOTION BY: Commissioner Zander SECONDED BY: Commissioner Marsh To have all open records requests forwarded to State's Attorney's office. DISPOSITION: Roll call vote. All voted aye. Motion Carried.
ELECTION WORKERS COMPENSATION At the December 8, 2020 meeting, it was requested that the Auditor or her designated persons bring a recommendation to the Commission regarding extra compensation of staff that assisted during the election. Chairman Franchuk would like to not move forward with this type of added compensation and would instead like to see employee evaluations determine raises. Chairman Franchuk also commented that he would like to have the Commission address paying health insurance for employees. Commissioner Marsh agrees and would like further discussion in the future. Commissioner Arthaud would like to look into the numbers of full benefits with the new HR person over the next few months.

Public attendee, Dave Beaudoin, requested information on where the amounts come from to amend these budgets. Auditor Betlaf explained that they come from our system. Mr. Beaudoin also wanted to know if taxes would be raised. Commissioner Messer stated that no taxes will be raised because we have the reserves to cover these budget downfalls.
