Revision 12, Permit ACPG-9701 Application Case No. RC-22-413 NOTICE OF PERMIT REVISION APPROVAL April 12, 2023 Preliminary Statement On November 25, 2022, American Colloid Company applied for a permit revision to modify surface coal mining and reclamation operations approved under Permit No. ACPG-9701 for its mine near Gascoyne, North Dakota. This revision identifies the next five-year coal removal subarea and updates legal information, operation plans, and other mining and reclamation plans for the next five-year permit term that will end on April 21, 2028. The Commission has completed its review of the application and approved the permit revision. The revision will give American Colloid Company the right to modify the mining and reclamation plans in Permit No. ACPG-9701 as described in the revision application. Notice Any person with an interest which is or may be adversely affected by this revision approval may request a formal hearing with the Commission within thirty days of the publication of this notice.
