Diversion entity sues for rights to road

FARGO -- One of the many governmental entities represented on the Fargo-Moorhead diversion authority is suing a Cass County landowner for road rights on their land under eminent domain.

FARGO - One of the many governmental entities represented on the Fargo-Moorhead diversion authority is suing a Cass County landowner for road rights on their land under eminent domain.
The lawsuit filed Tuesday in Cass County District Court asks the court to grant eminent domain access for both permanent and temporary roads across the land owned by Fercho Family Farms.
The roads are needed to create permanent ring dikes around the communities of Oxbow, Hickson and the Bakke subdivision that’s part of the $1.8 billion Red River diversion project to protect the Fargo-Moorhead area from flooding.
