BISMARCK (AP) -- A North Dakota legislator has pleaded guilty to assaulting his wife.

Bismarck Rep. Dave Weiler agreed to get a psychological evaluation and get domestic violence offender treatment as part of a plea deal.

Bismarck Municipal Judge William Severin deferred Weiler's sentence for a year. If Weiler meets the terms of his plea agreement, the incident will not become part of his record.

Weiler admitted to pushing his wife, Nicole, to the ground last month in the parking lot of a north Bismarck convenience store. Initial police reports said the incident happened in front of the couple's home.

Dave Weiler declined comment. Assistant Bismarck city attorney Paul Fraase (FRAY'-zee) said in a court filing that Nicole Weiler approved the settlement.

Dave Weiler is a 44-year-old Republican state representative. He was first elected to the House in 2000.
