HOUSTON (AP) -- A Texas agency is investigating whether a woman left seven preschoolers alone before a fire broke out in her Houston home day care center and killed three.

A spokeswoman for the Texas Department of Family and Protective Services says it's also is investigating whether the number of children in the home Thursday exceeded the state limit. Gwen Carter says state regulations allow no more than six children under preschool age to be cared for in any 24-hour period.

Eighteen-year-old Geoffrey Deshano lives near the day care and he says he saw operator Jessica Tata pull up in a minivan shortly before the fire. He says he told investigators he didn't see her take any children into the home before she came running out screaming for help.
