Kostelecky charged with sexual abuse of 14-year-old
Jayden Matthew Kostelecky had an initial appearance April 26 before Judge William Herauf in Stark County District Court.
Kostelecky, age 21, of New England, is charged with continuous sexual abuse of a minor, as well as gross sexual imposition. Both are Class A felonies.
The charges were filed April 25.
According to the criminal complaint, Kostelecky "engaged in any combination of three or more sexual acts or sexual contacts with a minor under the age of 15 years during a period of three or more months and, during that time, was then less than 22 years of age."
Kostelecky, on more than 10 separate occasions, touched his genitals to those of a 14-year-old, the complaint alleges.
For the charge of gross sexual imposition, the complaint alleges Kostelecky engaged in those sexual acts with the unnamed 14-year-old victim.
In North Dakota, a Class A felony carries a maximum sentence of 20 years imprisonment, a $20,000 fine, or both. The minimum court fees are $1,025.
Hettinger County State's Attorney Pat Merriman recommended $50,000 bond and no contact order with the victim and the victim's family.
"For the record, he does have a prior (contributing to the) delinquency of a minor (charge). I believe it was the victim's older sister and that was in 2017," Merriman told Herauf.
Kostelecky told Herauf he was going to apply for an attorney.
He asked Herauf if the bond could be reduced so he could get a job.
"I have zero money," he said. "I've lived here my whole life."
Herauf explained an application can be submitted for the bond to be reviewed.
No further court appearances have been scheduled.
